Terms & Conditions

The “Client” wish to undertake DIETITIAN GARIMA’S [Weight Loss/ Weight Gain/ Therapeutic diet] Programme. The Client hereby agrees to the terms and conditions of DIETITIAN GARIMA as set out herein:-
1) DIETITIAN GARIMA provides weight loss/ weight gain management and information and is intended only to assist Clients in their personal Weight loss/ Weight gain/ Therapeutic diet management efforts. The DIETITIAN GARIMA Weight Loss/ Weight Gain/ Therapeutic diet management Programme is developed by respected health professionals. Not following the programme, as designed may pose the risk of developing health complications associated with rapid weight loss/ weight gain and therefore any deviation from the programme designed for the Client, is at the Client’s risk and DIETITIAN GARIMA including its proprietor/ staff is not responsible for any adverse complications, which may result there of.
2) DIETITIAN GARIMA requires written medical permission from a general practitioner or concerned doctor for Clients who are below the age of 18 years/ are pregnant / suffer from a terminal illness/ or need any therapeutic dietary modifications. In addition, teens and women nursing a child who wants to enroll in a Diet management programme must follow a specific plan and policies to meet their specific requirements in consultation with their physician.
3) DIETITIAN GARIMA is not a medical organization and DIETITIAN GARIMA’s proprietor/ staff cannot provide medical advice or diagnosis. Nothing contained in DIETITIAN GARIMA’S diet should be construed as medical advice or diagnosis. The information and reports generated by DIETITIAN GARIMA should not be interpreted as a substitute for physician consultation, evaluation, or treatment. The advice given by DIETITIAN GARIMA is NOT definitive or binding medical advice and is NOT intended to diagnose, prescribe, nor endorse any brand of products or services. If you are being treated for an illness, taking prescription medication, or following a therapeutic diet to treat a disease, it's especially important to show the DIETITIAN diet plan to your physician. Any modifications made to the plan by the Client’s physician should be followed. It is the sole duty of the Client to consult with a doctor before starting any weight loss/ weight gain or diet programme. The Client undertakes to get the diet chart prescribed to the Client by DIETITIAN GARIMA approved by the Client’s family physician/ doctor as required from time to time.
4) The Client sincerely believes that DIETITIAN GARIMA, its proprietor/ employees/ agents/ representatives will give the Client the best services possible. The Client shall not hold DIETITIAN GARIMA, its proprietor/ employees/ agents/ representatives responsible for any consequences of the treatment or following the prescribed diet. The Client understands that the prescribed diet chart as prepared by the DIETITIAN GARIMA professionals from time to time is prepared to achieve the targeted goals as discussed with the client. However the Client shall not hold DIETITIAN GARIMA, its proprietor/ employees/ agents/ representatives for any consequences that may arise due to following the prescribed diet chart as modified from time to time in the event that the targeted weight loss/ weight gain is not achieved by the Client during the stipulated time period.
5) The Client has understood that the weight loss programme which the Client has enrolled and opted for will expire within given weeks from the date of enrolment or on the target date specified and communicated to the Client or if the target achieved is arrived at by the Client, whichever event happens at the earliest from the date of enrolment by the Client. Thereafter, the Client has two options which include either to enroll for a maintenance programme or for a further weight loss programme, if so advised. The Client further accepts that on enrolling for further weight loss programme or for a maintenance programme, the Client will have to pay the applicable charges to DIETITIAN GARIMA.
6) The Client accepts and understands that the programme enrolled for will be effective from the date of enrolment and making available by DIETITIAN GARIMA the diet chart to the Client. If, however, for whatsoever reason the Client desires to place on hold the enrolled programme, the Client will in writing communicate the same to DIETITIAN GARIMA and the maximum period for which the programme can be placed on hold or postponed would be two months from the date of enrolment and the same would automatically expire at the expiry of the hold period of two months.
7) The Client accepts that if for whatsoever reason, the Client fails and neglects to visit or consult DIETITIAN GARIMA for a period of four weeks, during the validity of the enrolled programme, DIETITIAN GARIMA will through the medium of email or sms or personal call, follow-up once a week for a period of four weeks thereafter and if the Client fails to respond and /or attend DIETITIAN GARIMA for consultation, the programme enrolled into will thereafter expire on such negligence on the part of the Client and the enrolment will automatically come to an end. DIETITIAN GARIMA clarifies and the Client further understands that inspite of follow-ups by DIETITIAN GARIMA, if the Client thereafter fails and neglects to attend for three consecutive consultations without any prior intimation to DIETITIAN GARIMA, the programme enrolled by the Client will automatically come to an end without any further intimation to the Client.
8) The Client understands the contents of the terms and conditions of DIETITIAN GARIMA set out herein and the Client accepts the terms and conditions voluntarily and understands the consequences thereof.
9) The Client shall not hold DIETITIAN GARIMA its proprietor/ employees/ agents/ representatives responsible for any consequences that may arise /occur due to following this prescribed Diet therapy. The Client expressly understands and agrees that DIETITIAN GARIMA, its proprietor/ employees/ agents/ representatives shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, or any other damages whatsoever, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if DIETITIAN GARIMA its proprietor/ employees/ agents/ representatives have been advised of the possibility of such damages), arising out of, or resulting from, (a) the use or the inability to use DIETITIAN GARIMA Diet plans; and (b) the use of any content or other material from DIETITIAN GARIMA. In no event shall DIETITIAN GARIMA, its proprietor’s/ employees’/ agents’/ representatives’ total liability to the Client for all damages, losses, and causes of action [whether in contract, tort (including, but not limited to, negligence), or otherwise] exceed the amount paid by the Client.
10) Client accepts that the any charges paid by the Client to DIETITIAN GARIMA shall not be refunded to the Client under any circumstances, including discontinuance of treatment by me, for whatsoever reason.
11) If the Client is dissatisfied with DIETITIAN GARIMA’S its proprietor’s/ employees’/ agents’/ representatives’ services, or with any of these terms & conditions, the Client’s sole and exclusive remedy is the discontinuation of use of the DIETITIAN GARIMA Diet Programme.
12) These terms and conditions shall be governed by the laws of India. The courts of Ludhiana shall have exclusive jurisdiction for any disputes arising between the Client and DIETITIAN GARIMA, its proprietor/ employees/ agents/ representatives.
